1. Introduction

These Terms of Service ("Terms") govern your access to and use of Assessain, provided by Juda Kaleta, IČO 03897508, Kollárova 456, 509 01 Nová Paka, Czech Republic ("we", "us", or "our").

By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, do not use the platform.

2. Service Description

Assessain is an online platform that helps educators grade paper-based assessments using AI tools. We offer features such as worksheet uploads, QR code generation, scanning, automatic grading, and performance analytics.

3. Eligibility

To use Assessain, you must be at least 18 years old or have legal capacity under your local law. By using the platform, you confirm that all information you provide is accurate and complete.

4. Account Registration

You must register for an account to use certain features. You are responsible for maintaining the confidentiality of your login credentials and all activity that occurs under your account.

5. Pricing and Payment

Certain features may require payment. Prices are listed on our Pricing Page. All charges include VAT if applicable.

Payments are processed securely via Stripe. By purchasing a paid plan, you agree to recurring billing (monthly or yearly) unless cancelled.

6. Free Trial and Right of Withdrawal

We offer a free trial with no payment required. If you later purchase a paid plan, you acknowledge that digital content will be delivered immediately and you waive your right to withdraw under EU consumer protection law.

By continuing with payment, you agree:

“I expressly consent to the immediate performance of the service and acknowledge that I will lose my right of withdrawal once the performance has begun.”

7. User Responsibilities

You agree to use the service in accordance with all applicable laws and regulations. You must not:

• Violate the intellectual property of others
• Upload offensive or unlawful content
• Attempt to reverse-engineer or interfere with the platform

You are responsible for any student or worksheet data you upload.

8. Intellectual Property

All content on the platform (except uploaded content) is our intellectual property and may not be copied, distributed, or modified without permission. You retain ownership of your uploaded materials but grant us a license to process them as needed to provide the service.

9. Service Availability

We strive to keep Assessain online and functional, but we do not guarantee uninterrupted access. We may suspend or modify the service for maintenance or improvements with reasonable notice where possible.

10. Termination

You may cancel your subscription or delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.

11. Limitation of Liability

To the extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability is limited to the amount paid by you in the 12 months prior to the event giving rise to the claim.

12. Privacy

We process your personal data in accordance with our Privacy Policy. By using Assessain, you consent to such processing.

13. Governing Law and Disputes

These Terms are governed by the laws of the Czech Republic. If you are a consumer, you may also benefit from mandatory protections under the laws of your country of residence.

Any disputes may be resolved out of court. Consumers in the EU may use the ODR platform.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the platform or email. Continued use of the service after such changes constitutes acceptance.
